Terms & Conditions for Mobile Phone Recycle Service

 

These Terms and Conditions govern your use of www.hmvmobiletradein.com website (hmv mobile recycle website). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use the Service or the hmv mobile recycle website.

The Service is offered by zonzoo Limited on behalf of hmv.

The hmv mobile recycle website is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the hmv mobile recycle website you agree to be bound by these Terms and Conditions. Please review them in detail.



Benefits of the Service
1. The Service is offered in return for hmv vouchers up to the value identified for your Functioning phone(s) (or a monetary donation on your behalf to the Clic Sargent Charity).

2. The hmv mobile recycle website provides details of the value of the hmv voucher you will receive. The value of the hmv voucher varies depending on the make and model of your mobile phone.

3. Your hmv vouchers will be dispatched once we have verified that the mobile phone received from you matches the details you selected on the hmv mobile recycle website.

4. If your mobile phone model is not listed on the hmv mobile recycle website then you are not eligible to use the Service. However, any phone that is not listed may still be recycled free of charge to you and we will make a donation of £2.50 to CLIC Sargent on your behalf.



Eligibility
5. The value displayed on the hmv mobile recycle website for a mobile phone is only valid if the mobile phone is functioning. Your mobile phone must (1) include a working battery; (2) Power up/switch on and off; (3) contain a display panel which is intact; (4) not have been significantly damaged but may have mild cosmetic damage (from general wear and tear); (5) not have suffered water damage (6) appear in our online list (7) Be of UK/ European specification. If your mobile phone is not functioning (as defined in this clause), we reserve the right to revise the value given to the mobile phone (see Point 8 below for more details) or reject the mobile phone.



How the Service works
6. If you are eligible to use the Service, you must submit the online form providing your contact details on the hmv mobile recycle website. Our offer to recycle your mobile phone remains open for 21 days only. This period will commence on the date you submit the online form on the hmv mobile recycle website.

7. Within 3 working days from the date you submit your form online, we will send you a return postage paid envelope. In order for the value shown for the mobile phone on the hmv mobile recycle website to remain valid, your mobile phone must be received by us in the postage paid envelope within 21 days of your initial online registration. To allow for unexpected postal delays we suggest that you return the mobile within ten days of receiving your return envelope. Do not send mobile phone chargers or other mobile phone accessories to us as these will not increase the value of the mobile phone and may damage the postage paid envelope. Upon receiving the mobile phone, we will send you a confirmation email of receipt.

8. If you send us a mobile phone that does not exactly match the mobile phone selected by you on the hmv mobile recycle website (for example, the mobile phone is a different model to that selected by you but is still a functioning mobile phone as defined in Point 5), we will send you an email with a revised value for the mobile phone. If you do not wish to accept our revised value and therefore not continue with the Service, you must contact us within 5 days from the date of the email containing our revised offer requesting that the mobile phone be returned to you (our contact email address is detailed in Point 20). If you do not make a request to returnthe mobile phone within 5 days from the date of the email containing our revised value, the mobile phone recycling will continue at the revised value sent to you. If you want the mobile phone returned to you using Special Delivery, please send a cheque in advance, made payable to ‘zonzoo Limited’ for £5.50, to zonzoo Limited, Units 3-4, Boundary Business Court, Mitcham, Surrey CR4 3TD.

9. All mobile phones received will be checked against a database of stolen mobile phones. In the event that we receive a mobile phone from you which is listed on the database, you will not receive a hmv voucher. We will provide the mobile phone to the Police together with your contact details so the Police can investigate.



Your responsibilities
10. You are responsible for cancelling any mobile phone contracts linked to the use or provision of the mobile phone sent to us by you as part of the Service. Neither hmv nor zonzoo Limited are responsible for any costs arising either before or after you send the mobile phone to us or arising from any other contractual arrangements between you and a third party in respect of the use or provision of the mobile phone. Any costs arising from a contract between you and any third party in connection with the provision or use of the mobile phone must be resolved between you and that third party. By sending us the mobile phone, you warrant that (1) you have full authority to do so; (2) it has not been stolen from any third party; (3) it does not belong to any third party, e.g. your employer; and (4) no restriction on disposal of the mobile phone has been imposed on you by your mobile phone provider/operator.

11. You must remove the SIM card from the mobile phone prior to sending it to us. If you send us a mobile phone containing a SIM card, we will destroy it. Neither hmv nor zonzoo Limited shall be responsible for the loss of a SIM card or disclosure of any information on it.

12. Please ensure all information is deleted from your mobile phone. Neither hmv nor zonzoo Limited shall be responsible for the disclosure of any information contained in your mobile phone.



Sending your mobile phone
13. When sending your mobile phone to us, we suggest you obtain a Certificate of Postage if the value of your mobile phone is £32 or lower. A Certificate of Postage can be obtained free of charge from any Post Office. If the mobile phone is subsequently lost in the post, it will be covered up to a certain value which should be claimed directly from Royal Mail. If the value of the mobile phone is more than £32, we suggest you send it to us using Special Delivery available from the Post Office. If you choose to use Special Delivery, this will be entirely at your own expense. Special Delivery enables you to track your mobile phone until it arrives with us and will insure you against its loss. Neither hmv nor zonzoo Limited accept any responsibility for mobile phones that are not received by us.



Amendments
14. We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the hmv mobile recycle website. The changes will apply to the use of the hmv mobile recycle website after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the hmv mobile recycle website. If you continue to use the hmv mobile recycle website after the date on which the change comes into effect, your use of the hmv mobile recycle website indicates your agreement to be bound by the new Terms and Conditions.



Applicable law
15. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.

17. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

18. If you breach these Terms and Conditions and hmv ignores this, hmv will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

19. hmv shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
